General Survey Competition Terms and Conditions

1. The Promoter

1.1. The promoter is FutureLearn Limited of PO Box 77, Chambers Building, Walton Hall, Milton Keynes, MK7 6BT (“FutureLearn”).

1.2. These General Survey Competition Terms and Conditions apply alongside the FutureLearn Platform terms of use, which are available at /info/terms/. To the extent of any conflict between those terms, the FutureLearn Platform terms of use will take precedence to the extent of any such conflict.

2. Introduction

2.1. Unless otherwise stated or notified to you in advance, these General FutureLearn Survey Competition Terms and Conditions (“General Survey Competition T&Cs“) will govern all FutureLearn survey competitions.

3. The Competition

3.1. FutureLearn is offering a chance to win a Prize, as set out in to paragraph 6 below (the “Competition”) in accordance with these General Survey Competition T&Cs.

3.2. The Competition will run for the period stated within the relevant Survey.

3.3. By participating in the Competition you accept these General Survey Competition T&Cs.

3.4. Invitations to participate in a Survey are unique to the user and should not be shared or forwarded to any third parties. Doing so may invalidate any previous entries into the Competition associated with that Survey.

4. How to participate

4.1. Register as a user on FutureLearn; and

4.2. Complete a FutureLearn survey that states it includes a Competition (the “Survey”), before the Competition end date, and indicate that you would like to take part in that Competition.

5. Eligibility

In order to be eligible to participate in the Competition a registered user must:

5.1. have completed the applicable Survey within the specified time frame;

5.2. have answered all questions marked as required in the Survey;

5.3. have consented to participate in the Competition in the Survey;

5.4. not be an employee or supplier of FutureLearn, or a partner or relative of a FutureLearn employee; and

5.5. only have completed the Survey once.

(“Eligible Participants”)

6. Prize draw and redemption

6.1. For each Competition, FutureLearn Ltd will choose the winner of the Prize via a random draw, from all valid entries received from Eligible Participants (the “Winner”).

6.2. There will ordinarily be 1 Winner per Competition, unless no successful redemption takes place in accordance with these General Survey Competition T&Cs. FutureLearn reserves the right (but is under no obligation) to offer Prizes to more than one Winner per Competition.

6.3. The Winner will be selected through a computer based random draw within 7 days of the Survey ending.

6.4. Selection of Winners is a completely random process over which FutureLearn exercises no judgment and no correspondence will be entered into in respect of Competitions.

6.5. Identities of Winners will not be disclosed or published.

6.6. An email will be sent to the Winner (the “Email“). asking them to confirm the Prize that they wish to receive and the email address to send it to. To redeem their Prize, Winners must reply to the Email within 7 days of it being sent by FutureLearn with the details requested (the “Redemption Email”).

6.7. Unless otherwise stated, the Email will be sent to the email address associated with the Winner’s FutureLearn account, and Redemption Emails should be sent to the email address associated with the Email.

6.8. Successfully redeemed Prizes will be sent to the Winner by email within 30 days of receiving their Redemption Email.

6.9. If the Redemption Email is not received by FutureLearn within the stated time, FutureLearn reserves the right to revoke the Prize and award it to another Eligible Participant using the random Winner selection process described above. The same redemption process will apply in each instance, until the Prize is successfully redeemed or withdrawn by FutureLearn, at their discretion.

6.10. By participating in the Competition and accepting these General Survey Competition T&Cs you consent to FutureLearn using your personal information to contact you if you are a Winner.

7. The Prize

7.1. Winners must choose a Prize from the following list (unless otherwise stated), which may be amended at FutureLearn’s discretion from time to time without notice (the ‘Prize’):

(a) £25 Amazon.co.uk (United Kingdom) Gift Card, emailed;

(b) £25 worth of Amazon.ca (Canada) Gift Card in Canadian Dollars, emailed;

(c) £25 worth of Amazon.com (USA) Gift Card in US Dollars, emailed;

(d) £25 worth of Amazon.fr (France) Gift Card in Euros, emailed;

(e) £25 worth of Amazon.de (Germany) Gift Card in Euros, emailed;

(f) £25 worth of Amazon.it (Italy) Gift Card in Euros, emailed;

(g) £25 worth of Amazon.es (Spain) Gift Card in Euros, emailed;

(h) £25 worth of Amazon.cn (Mainland China) Gift Card in Yuan Renminbi, emailed;

(i) £25 worth of Amazon.co.jp (Japan) Gift Card in Yen, emailed;

(j) £25 paid to a Personal Paypal account; or

(k) A FutureLearn voucher which may be used to upgrade any course, valid for one year from issue.

7.2. The FutureLearn voucher described in 7.1(k) cannot be used on paid-for courses, to purchase a Certificate of Achievement or purchase FutureLearn Unlimited.

7.3. There is no cash alternative for a Prize and all Prizes are subject to availability.

7.4. A Prize is non-transferable.

7.5. FutureLearn accepts no responsibility for any costs involved in using a prize, such as delivery, currency conversions or customs charges.

8. Limitation of Liability

Insofar and to the maximum extent as is permitted by law, FutureLearn, its agents or distributors will not under any circumstances be responsible or liable to compensate a Competition participant or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the Competition except where personal injury or death is caused by the negligence of FutureLearn, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. General

9.1. If there is any reason to believe that there has been a breach of these General Survey Competition Terms and Conditions, FutureLearn may, at its sole discretion, reserve the right to exclude you from participating in the Competition.

9.2. FutureLearn reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary in FutureLearn’s sole discretion to do so.

9.3. FutureLearn reserves the right to update or amend these General Survey Competition T&Cs (as well as any other policies or guidance we issue) from time to time to comply with law or to meet our changing business requirements, without notice to you. By continuing to participate in the Competition, you agree to be bound by the terms of these updates and amendments.

9.4. In the event that FutureLearn deems an individual has acted in bad faith with respect to the Competition, the individual will be excluded from the Competition and consequently be ineligible to claim the benefits of any Prize.

9.5. If any of these General Survey Competition T&Cs are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the remainder of the General Survey Competition T&Cs remain in full force and effect.

9.6. Only you and we are entitled to enforce these General Survey Competition T&Cs. No third party is entitled to enforce any of the General Survey Competition T&Cs, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 (which is expressly excluded) or otherwise.

9.7. We may freely transfer or assign any part of our rights or delegate our obligations under these General Survey Competition T&Cs. You are not entitled to transfer or assign, by operation of law or otherwise, any part of your rights or delegate your obligations under these General Survey Competition T&Cs without our prior written consent.

9.8. These General Survey Competition T&Cs set out the entire agreement between you and us in respect of the Competition and replace any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law as relate to the Competition. Any delay or failure by us to exercise any right we may have under these General Survey Competition T&Cs does not constitute a waiver by us of that right.

9.9. These General Survey Competition T&Cs shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
