Study UK Campaign Terms And Conditions

1.  THE PROMOTER

1.1  The promoter is FutureLearn Limited of PO Box 77, Chambers Building, Walton Hall, Milton Keynes, MK7 6BT (“FutureLearn”).

1.2  These Terms and Conditions apply alongside the general terms of use of the FutureLearn platform, which are available at /info/terms/.

 

2.  THE CAMPAIGN

2.1  The title of the campaign is ‘The Study UK Campaign’ (the “Campaign”).

2.2  As part of the British Council’s ‘Study UK Campaign’, FutureLearn will offer a limited number of free upgraded access (the “Upgrades”) on a first come first serve basis to Eligible Learners (as defined in paragraph 4.1 below) registered on certain Eligible Courses (as defined in paragraph 4.2 below).

2.3 The campaign will run from 4 October 2021 (the “Opening Date“) to 26 February 2022 or until such time that all Upgrades have been awarded, whichever is earlier (the “Closing Date“) inclusive.

 

3.  HOW TO PARTICIPATE

3.1  There is no charge to register for use of the website.

3.2  By registering on an Eligible Course and confirming that you are an Eligible Learner, you are agreeing to be bound by these Terms and Conditions.

4.  ELIGIBILITY

4.1  The Campaign is only open to residents in the following countries: Afghanistan, Albania, Algeria, Angola, Antigua and Barbuda, Argentina, Armenia, Azerbaijan, Bangladesh, Belarus, Belize, Benin, Bhutan, Bolivia, Bosnia and Herzegovina, Botswana, Brazil, Burkina Faso, Burundi, Cambodia, Cameroon, Cape Verde, Central African Republic, Chad, China, Colombia, Comoros, Congo, Congo (Dem. (“Eligible Learners”)

4.2 The Campaign only applies to the list of courses available on https://futurelearn.com/study-uk-courses. (“Eligible Courses”)

4.3  The Campaign only applies to Eligible Courses which are commenced by an Eligible Learner and on which the Necessary Steps are completed before the Closing Date.

4.4  The Campaign only applies to Eligible Learners who complete five (5) steps on an Eligible Course (the “Necessary Steps“).

4.5  In participating in the Campaign, you confirm that you are eligible to do so and eligible to claim a free upgraded access. FutureLearn may require you to provide proof that you are eligible to participate in the campaign.

 

5.  THE UPGRADES

5.1  A maximum of fifty thousand (50,000) Upgrades are available as part of the Campaign.

5.2  Upgrades will be awarded on a first come first serve basis and will be limited to one (1) Upgrade per Eligible Learner.

5.3  There is no cash alternative for an Upgrade.

5.4  Upgrades are non-transferable.

5.5 Upgrades include the following in relation to an Eligible Course:
5.5.1 Ongoing access to the course for as long as it exists on FutureLearn;
5.5.2 Access to tests if there are any; and
5.5.3 A digital only certificate providing you meet the eligibility criteria available at /proof-of-learning/certificate-of-achievement

 

6.  LIMITATION OF LIABILITY

Insofar as is permitted by law, FutureLearn, its agents or distributors will not in any circumstances be responsible or liable to compensate a participant or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the Campaign except where it is caused by the negligence of FutureLearn, its agents or distributors or that of their employees. Your statutory rights are not affected.

 

7.  GENERAL

7.1  If there is any reason to believe that there has been a breach of these Terms and Conditions, FutureLearn may, at its sole discretion, reserve the right to exclude you from participating in the Campaign.

7.2  FutureLearn reserves the right to hold void, suspend, cancel, or amend the Campaign where it becomes necessary to do so.

7.3  FutureLearn reserves the right to update or amend these Terms (as well as any other policies or guidance we issue) from time to time to comply with law or to meet our changing business requirements, without notice to you. By continuing to participate in the Campaign, you agree to be bound by the terms of these updates and amendments.

7.4  In the event that FutureLearn deems a learner to have acted in bad faith with respect to the Campaign, the learner will be excluded from the Campaign and consequently be ineligible to claim the benefits of any Upgrade.

7.5 If any of these Terms are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the remainder of these Terms remain in full force and effect.

7.6  Only you and we are entitled to enforce these Terms. No third party is entitled to enforce any of these Terms, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 (which is expressly excluded) or otherwise.

7.7  We may freely transfer or assign any part of our rights or delegate our obligations under these Terms. You are not entitled to transfer or assign, by operation of law or otherwise, any part of your rights or delegate your obligations under these Terms without our prior written consent.

7.8  These Terms set out the entire agreement between you and us in respect of the Campaign and replace any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law as relate to the Campaign. Any delay or failure by us to exercise any right we may have under these Terms does not constitute a waiver by us of that right.

7.9   These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
